Welcome to Amy Eira Jewellery (“AEJ”, “we”, “us” or “our”). We operate this store and website, including all related information, content, features, tools, products and services, to give you a curated jewellery shopping experience (the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.
The terms and conditions below, together with any policies referenced in them (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.
Please read these Terms carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability. By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not use or access our Services.
1. Access and account
By agreeing to these Terms, you confirm that you are at least 18 years old, or that you have your parent or guardian's consent to use the Services.
To use the Services, including browsing our online store or purchasing any products, you may be asked to provide certain information, such as your email address, and billing, payment and shipping details. You confirm that all information you provide is correct, current and complete, and that you have all rights necessary to provide it.
You are solely responsible for maintaining the security of your account credentials, if you choose to create an account, and for all activity on it. You may not transfer, sell, assign or license your account to anyone else.
2. Our products
We make every effort to provide an accurate representation of our jewellery on this website. However, please note that colours or appearance may differ slightly from how they appear on your screen, depending on your device and its settings.
Many of our pieces are handmade and hand stamped rather than produced by machine, so you may notice small natural variations between pieces. These are part of the handmade character of the jewellery and are not considered faults.
Product descriptions are subject to change at any time without notice. We reserve the right to discontinue any product at any time, and to limit quantities offered to any person.
3. Orders
When you place an order, you are making an offer to purchase. We reserve the right to accept or decline your order for any reason, at our discretion. Your order is not accepted until we confirm acceptance, and we must receive and process your payment before it is accepted. Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests once an order is accepted. If we do not accept, need to change, or need to cancel an order, we will try to contact you using the email address, billing address and/or phone number you provided.
Your purchases are subject to return or exchange in accordance with the Returns section below.
You confirm that your purchases are for your own personal or household use, and not for commercial resale or export.
4. Prices and billing
Prices, discounts and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed, as set out in your order confirmation email. Unless stated otherwise, posted prices do not include taxes, shipping, handling, customs or import charges, which are your responsibility where they apply.
Prices on this website may differ from prices offered elsewhere, including at markets or events. If we offer a promotion with its own terms, and there's a conflict with these Terms, the promotion's terms will govern.
You agree to provide current, complete and accurate payment and account information, and to promptly update it (for example your email address or card details) so that we can complete your transactions and contact you if needed.
You confirm that: (i) the payment information you provide is true, correct and complete; (ii) you are authorised to use the payment method provided; (iii) charges incurred by you will be honoured by your card provider; and (iv) you will pay all charges you incur at the posted prices, including shipping and any applicable taxes.
5. Shipping and delivery
All delivery times are estimates only and are not guaranteed. We are not liable for delays caused by shipping carriers, customs processing, or events outside our control. Once we hand a product to the carrier, you are responsible for it, which is why we recommend a trackable, insured delivery service for valuable items (see Returns, below, for more on this).
6. Personalisation
Any jewellery that has been personalised cannot be returned or exchanged, as each piece is individual and bespoke. When ordering a personalised piece, you'll be asked to confirm that the wording is correct, as mistakes cannot be rectified afterwards. Please be aware that personalised pieces are hand stamped rather than machine made, so there may be small imperfections.
7. Returns
We accept returns within 14 days of receipt of goods ordered online, and you may return the item(s) for any reason, with the exception of earrings (for reasons of hygiene) and items that have been specifically personalised. You must take reasonable care of goods in your possession, as we will not exchange or refund goods that show obvious signs of rough handling or damage, or that don't have their original packaging in a saleable condition. In this instance, the goods will be returned to you at your own cost.
To arrange a return, please contact us to request one, quoting your name and address, details of the product, and the reason for the return.
Your original postage costs will not be refunded unless the item you received was sent in error, or has been identified as faulty or damaged (provided we are notified within 7 days of receipt). Once a return is approved, the goods must be returned within 28 days of you receiving them, and you will be refunded within 14 days of our receipt of the returned goods.
The jewellery remains your responsibility until it reaches us, so we recommend sending the parcel using a trackable, insured service such as Royal Mail Special Delivery. We cannot be held responsible for returns that are lost in transit.
8. Faulty items
Items are classed as faulty if they are received damaged, or if a manufacturing fault occurs within three months of purchase. Items damaged through general wear and tear are not considered faulty. All items are checked and quality controlled before leaving the workshop. If you receive an item that has been damaged in transit, please contact us immediately.
9. Warranty
During the warranty period of twelve months from purchase, we will repair or replace, at no charge, any item that proves defective due to faulty material or workmanship, under normal use and care. Normal wear and tear is not covered by this warranty. Proof of purchase is required.
10. Wear & tear
We don't recommend wearing your jewellery when participating in sports or gym use, sleeping, or swimming. Solvents, bleaches, household chemicals and cleaning products can tarnish silver. Some skin types can make silver go black; this is only surface discolouration and can easily be removed with a soft, clean cloth.
11. Rings with stones
Take extra care to protect stones from knocks and scratches. These cannot be resized once worn. If the back of the stone is exposed, clean it regularly by soaking in warm water with a small amount of washing-up liquid.
12. Care
Silver jewellery will naturally tarnish over time. Keep your jewellery clean and free from creams, lotions, oils, perfumes and make-up. When not wearing it, store your jewellery separately so it doesn't get scratched or tangled. We recommend storing jewellery out of strong sunlight, either in its original packaging or a jewellery box.
13. Holiday care
Keep jewellery free from sun cream and after-sun lotion. Avoid wearing it in swimming pools or jacuzzis, as chlorine may tarnish silver. Store it safely when not wearing it.
14. Intellectual property
Our Services, including all trademarks, brand assets, text, images, graphics, product photography, and the design and arrangement of the website, are owned by us or our licensors and are protected by UK and international copyright, trade mark and other intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store or transmit any material from the Services without our prior written consent. Nothing in these Terms grants you a licence or other rights under any patent, trade mark, copyright or other intellectual property of mine, Shopify's, or any third party. Unauthorised use of the Services may infringe intellectual property law.
Amy Eira Jewellery's name, logo, and product names are trademarks of mine, and you must not use them without our prior written permission. Shopify's name, logo and product names are trademarks of Shopify. All other names, logos and product names on the Services belong to their respective owners.
15. Optional tools
You may be given access to tools offered by third parties as part of the Services, which we neither monitor nor control. We provide access to such tools “as is” and “as available,” without warranties of any kind, and we have no liability arising from your use of them. Any use of optional third-party tools is entirely at your own risk, and you should be familiar with the third-party provider's own terms before using them.
16. Third-party links
The Services may contain links to websites operated by third parties. We're not responsible for examining or evaluating the content or accuracy of any third-party site, and if you choose to follow a link away from our Services, you do so at your own risk. We're not liable for any harm related to your use of third-party websites or their products and services. Please review third-party policies carefully before engaging in any transaction with them.
17. Our relationship with Shopify
Our store is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make through our store are made directly with us. By using the Services, you acknowledge that Shopify is not responsible for any aspect of any sale between you and us, including any injury, damage or loss resulting from a purchased product. You release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with us.
18. Privacy policy
All personal information collected through the Services is subject to our Privacy Policy, which you can view here, and certain personal information may also be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read these policies.
Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit will be transmitted to and shared with Shopify, and in some cases with third parties in other countries, in order to provide the Services to you. See our Privacy Policy for more detail on how we, Shopify, and our partners use your personal information.
19. Feedback
If you submit any ideas, suggestions, reviews or other feedback (“Feedback”), you grant us a perpetual, worldwide, royalty-free licence to use, reproduce, modify, publish and display that Feedback for any purpose, including commercial use. We're under no obligation to keep your Feedback confidential, to pay compensation for it, or to respond to it.
You confirm that you own or have the rights to any Feedback you submit, and that it won't infringe anyone's intellectual property or other rights, or contain anything unlawful, abusive or obscene. You may not use a false email address or pretend to be someone other than yourself when submitting Feedback. You're solely responsible for your Feedback and its accuracy.
20. Errors, inaccuracies and omissions
Occasionally there may be information on our Services that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges or availability. We reserve the right to correct any such errors and to change, update or cancel orders if information is found to be inaccurate, at any time and without prior notice, including after you've submitted your order.
21. Prohibited uses
You may access and use the Services for lawful purposes only. You must not use the Services to:

We reserve the right to suspend, disable or terminate your account at any time, without notice, if we determine that you've violated these Terms.
22. Agents
This section applies if you use, enable, or cause the deployment of an “Agent” (any software that takes autonomous or semi-autonomous action on behalf of a person, without direct supervision) to access or interact with the Services.
No Agent may access or interact with the Services unless it identifies itself and operates in accordance with the requirements below, and we may at any time request that an Agent stop accessing the Services. Agents must: identify themselves as an Agent in the user agent string of any request (e.g. “Agent/[agent name]”); not conceal that interactions are coming from an Agent, including by mimicking human behaviour or bypassing CAPTCHAs; respond truthfully if asked whether an interaction is from a human or a computer; and not circumvent any measure we use to control how Agents access the Services.
23. Termination
We may terminate this agreement or your access to the Services, in whole or in part, at our sole discretion and at any time, without notice. You will remain liable for all amounts due up to and including the date of termination.
The following sections will continue to apply after termination: Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provision that by its nature should survive termination.
24. Disclaimer of warranties
Information presented on the Services is provided for general information purposes only. We don't warrant the accuracy, completeness or usefulness of this information, and any reliance you place on it is at your own risk.
Except as expressly stated, the Services and all products offered through them are provided “as is” and “as available,” without warranties or conditions of any kind, either express or implied, including implied warranties of satisfactory quality, fitness for a particular purpose, and non-infringement. We don't guarantee that your use of the Services will be uninterrupted, timely, secure or error-free. This doesn't affect your statutory rights as a consumer under UK law, which are not excluded by this clause.
25. Limitation of liability
To the fullest extent permitted by law, we, our agents, contractors and service providers, and those of Shopify and its affiliates, will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Services or any product purchased through them, including loss of data or lost savings, whether based in contract, tort (including negligence) or otherwise, even if advised of the possibility of such damages.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited or excluded under English law.
26. Indemnification
You agree to indemnify and hold harmless us, Shopify, and our respective affiliates, agents, contractors and service providers from any losses, damages, liabilities or claims, including reasonable legal fees, arising from your breach of these Terms, your violation of any law or third-party right, or your use of the Services.
We will notify you of any claim covered by this section, though a delay in doing so won't release you from your obligations unless it materially prejudices you. We may control the defence and settlement of such a claim, but won't settle in a way that imposes non-monetary obligations on you without your consent.
27. Severability
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the unenforceable part will be severed, without affecting the validity of the remaining provisions.
28. Waiver; entire agreement
Our failure to exercise or enforce any right under these Terms will not be treated as a waiver of that right.
These Terms, together with any policies referenced in them, constitute the entire agreement between you and us regarding your use of the Services, and supersede any prior agreements or communications, whether oral or written, including earlier versions of these Terms.
29. Assignment
You may not transfer or assign these Terms, or any of your rights or obligations under them, without our prior written consent, and any attempt to do so will be void. We may transfer or assign these Terms without notice to you.
30. Governing law
These Terms are governed by and construed in accordance with the laws of England and Wales. You and we both agree to submit to the exclusive jurisdiction of the courts of England and Wales, save that if you are a consumer resident elsewhere in the UK, you may also bring proceedings in your local courts.
31. Headings
The headings in these Terms are included for convenience only and do not limit or affect their meaning.
32. Changes to these terms
You can review the most current version of these Terms at any time on this page. We reserve the right to update, change or replace any part of these Terms by posting changes to our website. We'll notify you of any material changes in accordance with applicable law. Your continued use of the Services after any changes are posted constitutes acceptance of those changes.
